February 9, 2026 – Planning Board – Video & Transcript
February 9, 2026 - Planning Board
This is the continuation of the planning board's meeting of February 9th, 2026.
We've just finished with the Scenic Road Trend Earring with the Board of Public Works.
And I've already called up in order.
At this point, we're going to move on to the rest of our agenda this evening.
And we're up to, we have several things, I guess I didn't announce our full agenda before, I will now.
We have review and approve the minutes of 12, 29, 25, and 1, 7, 26.
The minutes for 1, 28, 26 are not available.
Then at 7.30, we're going to recess and join the board, select board in their meeting room. And it will also be available, people can come in person, and it's also available online. And the link is at the select board's link. And at that meeting, we'll be discussing their proposal for Route 20 task force, our proposed zoning articles for town meeting, perhaps their proposed zoning article for town meeting, and in general, an approach to planning. So let's move on to our minutes, if we can. The minutes of December the 29th, December 12th, 2029. Yes, I provided you guys an updated version of track changes. Because I don't know if that'll be right. What? I don't have to talk a little bit louder. I provided you guys a new copy with some updated changes of suggestions from a member of the board prior to this meeting. And it was on page 3 below. I don't know if there was any changes, but both set out. Does anyone have any other comments other than the one that was inserted into the minutes? Yeah. I'm good. Okay. Larry, are you okay? You're not. I'm not. I'm not yet. He's coming down. He might just be. Yeah. Okay. Um, at this point, I guess I should say at this, Larry Kiernan was not here when we, um, moved into our own planning board session, he shows up, we will, uh, announce that he's shown up. Um, does anybody have any comments on the minutes or, um, how do you, are you okay with the addition that's been added? Okay. I'm okay with Ms. There. Do you want motion? Well, let's just make sure everybody's ready. Yeah. Okay. Move that we approve the minutes, uh, of 12, 29, 20, 25 as an end of the second. Oh, and three first. Oh. Yes. Yes. Well, we're here in person. We don't need to do this. Yeah. But four. Four or zero. Thank you, Robin. Do you mind? Do you mind? Do you mind? Do you mind? Do you mind? Yeah. I'm sorry. You're in a moment. So, January 7th, 20, 26. Who notices the change in the format? Because the Town Court has given us new formats, of our agendas and our minimum, so modern. Yeah. Snappy. Takes up too much room. Yeah. And it's really hard to manage actually. Gen Ethereum. So we're there any comments on the minutes of January? are there any comments on the minutes of january 7th 2026 i have not was sort of on the meeting
as per usual we talked about the there was a public hearing for the zoning permits oh yes right
i have no changes anything else have any changes i vote that we approve the minutes from january 7th 2026 is written second all the favorite all right four zero
sorry so if we can finish everything else before we go to select what it's done yeah that would be good yeah everybody's going to be down for internet next thanks um
we are going to be meeting and um that's wednesday because we have to go over the final decision and vote anyway and is there anything else happening robert uh we'll let you know that we don't have our money for minutes so even the plane board is going to be right minutes for it what i need to be right minutes into july first okay can we try and see how that works sure um and then perhaps if you know and work from there sure can we do it via the account that we already got yeah but you can also stick to that you can run you can also find things on the side yeah for me you can run like a little like a little bit on the side too i'll look i'll look into it maybe try a few different ways and see which one we like the result of better all of them there are also ones that you can you just have a device that sits here and it just gets the whole transcription yeah the whole transcript oh yeah because it would it would be yeah well might help but that's all i'm saying it's easier to just watch the tape yeah and speed ahead and stuff okay i think that's what i found we did that once um years ago and it was just don't call this is too much okay um and if we do that we're going to have to read the minutes very carefully to make sure that everything is there we need to read the minutes very carefully anyway make sure that nuances that we're talking about get into the minutes because the kinds of things that we talk about are kind of important for the future and for decisions that we need robert is that going to come back in july yeah okay so where are we now this is february we're a lot of meetings yeah so is that because we had a lot of meetings a lot of meetings yeah
and ron and ron is saying it's time to go for the means watch demon right but i did ask this for money and it was pushed back so of course back a year ago so i i thought i saw this coming okay well that'd be great we don't really want to do that but if somebody winds up having to take minutes normally it was the clerk or it was the uh associate member so that's why you're the clerk you're supposed to be a minute later but we've been trying to save you um as long as we can use the tool i am fine doing first yeah you would distribute them through robert yeah um so let's figure that out yeah i'm getting this meeting mixed up with what i put down for our next meeting um well why don't we talk about getting ready to talk to the board of public i mean to the select board um they're going to as you know they're going to want to talk about their 20 guest speakers um they want to talk about our proposed zoning articles and then they have one that they even made an additional change to late this afternoon again today yeah and it's supplemental no they didn't do it again yeah i have it yes i black i didn't send it to me i just i can i i mean it came in my inbox because i'm on this mailing list thing it sends everything to my inbox uh one minute i mean i can also find if i might fall into they also made changes to the root 20 master plan task force thing that was um different than what we had before but they didn't share it with us so can you do that too oh if it's in the packet oh i can find it that'd be the other yeah you want to see the changes they won't then i know it was in the supplemental package yeah i mean i'll look it up for now yeah like go through like a hawk but i don't go from like the day up well they should send them to us change i do the most people say make the point on the put on the task force would be people with legislative drafting experience to actually wade into starting to know the project instead of people who just want to have meetings talk about their wishes and dreams and i i mean i'd like you all to talk and i would like you all to talk before i talk i don't want to think it's coming just is it okay to say that absolutely say whatever you because the one thing we have trouble with is having enough time in our schedule to do the actual drafting that's the one thing that we have the most trouble with right but we don't want layman drafting no we need people with actual legislative drafting experience and preferably in land use right but all right so for me that's you for the so the changes there's been two changes to the uh article we call ee and the first one was originally the background i don't know if you get if you saw it it's a new one but the original one was like one sentence one new sentence added at section six point like 6.10.1 which is said that anybody who is um agreed by decision can can appeal they appeal um 20 days to based on national law 48 17 or 17. yeah it didn't exactly point that it just said any person yeah by a decision of planning with respect to site plan approval may appeal to the court of competent jurisdiction in accordance with general alex courtier 7 3. thank you larry now
it's seven o'clock and larry piernan has joined our meeting again now they're requiring anybody over x amount of uh square acreage or square feet or another parking space has to go to the select board to like introduce themselves which is kind of i had talked to our manager which is kind of like are you going to regulate that or this is it's going to be a friendly policy like we have it today they think that some people were mad that the copper church didn't you know have meetings with the the town which which is false they had that means with the land use people who have health planning building conservation this is going to regulate it so that you have to come to the select forward to the town what would this like it may is prior to submitting an application okay but like this process already happens that people do already come to the town and talk to it's just it's it's it's an overreach we'd like to supply me it sorry is there uh
it was over there there's only one did ira take it did you have one ira okay
okay well here's the trick you might have to share these i don't think you need the trees just to share the second second part of it anyways it's it's it seems like it's an overreach it seems like we really have a process that's happening um and if this process they were out here really interested in the process would be helpful to understand what happens now and how to help that process out then just putting insane zoning and then you know regulating it that way like there's the there's things we that i do that are like not in the books not in a bad way but like just like policy like when someone calls and asks questions about something i'm usually hey if you have more you want to sit down with everybody let's have a land use meeting this uh too regularly all this stuff is just too much it puts too much burden on the ground and the afghan 60 days like who decided what's 60 days how's that how do you determine 60 days and it's just it's just too much of that it's very complicated it's complicated that's good and in addition um um site plan isn't a state sanctioned function it's done by local bylaw and there's nothing in state law that requires site plan review um and the reason it's not already included in um the section of the law that they're talking about which is 40 a whatever it is the appeal 48 section 17 is because 48 17 is really only for appeals from the zoning board and for appeals um on special permits whether issued by the planning board or the zoning board so special permits i mean site plan approval what we're doing is trying to um mold what we'd like to see at a site as long as we stick within the parameters of our bylaws but what we're reviewing generally is something that is already and has of right use it's not that it needs a special comment um so adding this in isn't helpful and in addition what it does is it costs the town huge amounts of money in having to deal with it uh court proceedings no matter who sues we're going to have to defend and this is just giving us more opportunities to have the defense and in addition um when you're uh with the site plan approval there would be nothing in court i don't believe that would stop the project necessarily from moving forward um the building commissioner isn't technically bound by our decision building commissioner if we thought we were wrong in the site plan or if the applicant didn't agree with what we said and appealed to the building commissioner it's possible that the building commissioner could issue the part the building permits the way he wanted to unless it was because what we're doing for site plan isn't saying this is what you have to do and also with the ones that people are most concerned about the um dover amendment cases nobody has anybody right right i mean it's just this is it and it would go i mean it's just it's not fair to the applicant either to have to be get an appeal from our decision going straight to the zoning board the zoning board who has no background in done for them that stuff or all of the things that were in front of us uh who knows what they could decide and then you go to the building commissioner after that in the meantime probably if the building commissioner said i'm not going to issue i just um from it until you know until it's resolved then he'd be in court for years and that just doesn't seem appropriate for an asset right use to me anyway
i'd like if we can get the background information building here so we can find out what the intent of this is well we'll ask you now when we go through it um to have a hearing we can't have our own x square yeah right we need to have real actually real information originally the way it was written um um yeah they would go to the building commissioner the building commissioner would uh deny it would go to the um zoning board and um or the building commissioner would issue and it would go to the zoning board and in that scenario the project would not be stayed project would move forward and there's nothing in court that would i don't believe i can't think of anything egregious enough that would have the court say no stay the stay the development don't do any work we've had it the other way for years and it's working just fine okay that's that if anybody else have anything i'm curious if they fixed the really obvious typo that was in there wow and the second one down the decision of the planning approved oh yes and i saw it's like did you read it no so you guys there's still a little mistaken right there there's something else not too but something else i can be messed up on i didn't read it that closely at that point i just went slow yeah okay um then for ours you each know what you're going to talk about with them for the articles that you're responsible for right and ira you know that you're doing the housekeeping stuff right okay um speaking about one of the articles i i think that i got an email and she had a discussion with the with julie from facility's uh department and she she has some issues with them with the bylaw with what the energy committee um the ideas and they feel a little left out left out process yeah so intense um and i have that on our yeah we can do that we tried um number 20 yeah number 20 things um i think we already hashed that out when we met before our all of our board we talked about um the task force and not quite understanding what the purpose of it was and being able to discuss with this blackboard uh our what they have in mind and then what we have in mind yeah i re-read what they requested then but now know well do that is significant yes yes it's really um i i went through um the state statutes and i have them with me tonight um and it's clear that for planning documents it comes from the planets and we have had a lot planning that we have done over the years even the the last full master plan was an old fool there was an update in 2010 2011 um and the select board still hasn't done the tests that were assigned to them at the end of the uh the uh each version of that master plan there's a whole list of things that need to be done and things the planning board should do and the select board should do and the finance committee should do um and we've pretty much ticked off our stuff i think the planning board the select board hasn't um and then we also had um a lot of input when we did the um town center project before that and during the town center project um before that we had people who wanted uh development in the town center area we had multiple forms multiple reports uh then when we started on the town center project we had multiple forms multiple um surveys multiple reports um and we got what we got um and then um the wrap report which was done in 2017 still sits as a shelf document and it has on its main purpose to have a long-range plan for what the town wants to do and how it wants to develop um and we have looked at the um at our uh uh our master plan over the years we looked at it when we did the mvta zoning we looked at it when there was um the self-storage facility we looked at it when we were coming up with our list after we finished with beta of what we wanted to do and move forward with so i think that we can cut you off with them uh since since our last last year yeah i have a question should we summarize each of these points or we're expected to read no you just have to tell them yeah no i don't know what they're going to ask us they want to go over so i think you just say these things were um pointed out by um the people who make who do our code well we we've already done so i go into the finance committee so it's the same thing we did with finance committee last time we're doing it with selectment last time so you kind of give a summary and then i start your questions as well um but this came from the um the account yeah why don't you explain it to them it came from the e-code i think they they alerted the account clerk which then it gives a giant list of changes that need to be made i went through all the changes in net to make sure what changes are the easiest ones which ones are decent work and which ones we're not ready for so these are the most easiest changes changes of definition changes of of uh state organizations just honestly obvious obviously changes that very obviously should be modified and should be a no-brainer and next year we'll have more and we're going to string it out over a few years as what we got was like this thing wow huh and it took a long time to go through it and they found a lot of things that were not good and needed to be fixed so when we do talk about the 20 task force i hope all of you will speak um and speak before me i hope uh because i don't want you to think that your ideas are coming from me i don't actually like to be standing on our own do you know if we suggested to be the leader of the leader of this task force i think we could dance leader of this task force i don't think it's an improvement i don't think it's larry either
and i hope you will have a chance to uh read what gets sent over the weekend and get your comments back in property yeah great well is there anything else that anybody wants to talk about innocent people that is and get us ready for this so we're safe so so do we want to adjourn this meeting then are we ready to just completely adjourn it all right and go get into the system then we'll join the select board but then we won't come back is there anything else we need to do i don't know if they're on schedule no we have no idea all of the picture well yeah but did you do me a favor to go down and see there on schedule right yeah thank you i mean it's not anything major it's just no it's just like trying to make sure that somebody can understand that later right exactly exactly yeah yeah exactly that's right that's good and because it gets used to medication yeah yeah and that was why when i i know that change i played the minute yes thank you that was good because that's when we're going to want to do is that it that's why no no no no no it's important you know i bring back a lot of time um what we can work on what we mean well with regard to um
we looked i went back and looked at um the minutes of meetings that we had after the data presentation and after we went to the select board and and presented to them what the results of the beta report for um and um we had several meetings among ourselves and started working on i forgot we did that yeah no we did i i and i picked them up today because i thought people need to understand i mean we didn't create the beta report it came to us and we did a lot of work we had quite a few meetings oh yeah plowed through a lot but right then we had two dover minutes come in and that was the end of that right that's why i said that what we really need is help somebody who could help with doing some of the drafting get it started i have a plan loaded on the laptop and everyone wants to walk through it go for it well probably won't get that opportunity but i know i think they're like i should not even i'm i am that's what i'm just to say like there are bits and pieces of things that always will mastery about things that are in this plan that we've been getting off right every piece of that in towards the end we're getting some eps and airbase so they're talking about something about some of the school i mean i can't imagine being our what they're trying to discuss
period of their own schedule
about similar school i can't tell i can't tell if it was top of hollywood road oh it's like that's what i'm talking about yeah it's like a couple somewhere it's wrong so it was not in the not in the zoning language which is on the heading of it in the article yeah oh okay it's sure like southeast southwest okay she was great okay okay i'll get back to her i was right okay and can you fix that then yeah whoever needs to be fixed yeah that's okay sorry do you want to just have a motion not adjourn to recess and then we have to come back to adjourn um not necessarily we put adjourn there so um unless we have something to come back yeah i don't think we should do that i think i'm trying to reduce us yeah it's like i'm back here yeah right so i move that we recess this meeting so that we can go and find a select board meeting okay um we're all here so yeah and we're doing this yeah so we're working then we would like to come back we would likely come back um here to adjourn okay okay and it's five zero it's just positive it's positive yeah yeah
this is the wayland planning board and we have uh come back meeting with the board of the select board uh and the recent meeting now uh 9 13 p.m uh just for a brief meeting with new fellows and people I just want to, with you fellows and people, I just want to go over just the meeting that we just had with the select board, putting your thoughts on any of this stuff, I guess particularly on the task force idea. I'm sorry, suggestions about the task force? I'm wondering if they're all, I mean, I love what Robin and Jesse had to say, and I just wanted to make sure they're all on the same page. Yeah, I could just see them kind of bulldozing. Because they're going to bulldoze another consultant to come in, who have their own ideas, and you'll have to go all the way around to tell them they're not right. I don't think that's what, I think it's about bringing in somebody like, you know, EDC members. I'm curious to see what's in this email, that's going to come to us. Wait, what? Yeah. This note that's going to come to us, I'm curious to see what's in that. Oh. Yeah. You mean the master plan thing? Yeah. Yeah. I think if it really moves it forward, like does the things we need help with, then that's great. Yeah. But if it's just more people to sit around and talk about, wouldn't it be nice if we had a yoga studio in town? Like, yes, it would be. If you know somebody wants to do that, we should continue talking about it, but otherwise let's... Yeah, but it has to go in a commercial space with two residential units above us. Yeah. So, if it's a task force that actually moves the whole project forward, if it's just more people saying what they wish they had, that's not helpful. What is the end product? For them? Who knows? I know, did you see the... I have the document that's taken. Back in? Yes. Back in. Right. Is it a bunch of charts, or is it new zoning by... They want... Well, on this one, it was with the Route 20 Task Force with recommendations of consultants and engineer selection. Yeah. I see. I don't think that's exactly what they mean. For a Route 20 Master Plan. It's already done. And curve pump and sidewalk analysis. I think what we need is a group of folks to come together and chunk out what's in that plan into tiny, smaller projects. Yeah. And also to take what's in our, the existing zoning for that particular area, particularly that area, north of Route 20, between Route 20 and the rail trail, and figure out how to word the zoning so that you end up with the area that looks like what we want. A way to encourage pooled parking. A way to encourage, you know, buildings that look nice and have the business, but in a way that makes it easy for people to get in and out of there. Is there, you know, a plan to get some of the property or some property owner to say, yes, you could put, you know, a ramp up to the rail trail from here and we can use CPCS? You know the... Newtown Center people? Yeah. They're building integration right into the Route Trail. But that's the Newtown Center. Yeah. And we want to do that for the Old Town Center. Well, they're connecting to the rail trail. So the job for us is to get the boat north of Route 20 to connect to the rail trail. Right, right. So somebody's going to get a property owner. Yeah. That's what I'm saying. And then we could maybe get like CPCS money to help to put in that, a ramp or whatever town to that Route 20 section. I don't know. That's never going to happen. They're going to reorient. They're going to reorient. They're going to reorient parking lot to the rail trail, right where that, where it comes up the hill. Yeah. So, although I know, I originally envisioned a ramp, but it's just so crazy to create a ramp right next to... Yeah. Well, if you put a bike... Yeah. If you put a bike rack up by the rail trail, so then people can walk down. Yeah. They're moving the dumpsters. They're going to move the dumpsters. So if you could lock your bike up there and then walk down to the sub shop, that would be fine. Yeah. And that's what you talked to them about, but, and I haven't looked, we have zoning bylaw, site plan decision, and site that, and a regular decision that applied to that. And they'll come for, they, they were just saying they want to reorient. Right. And that's great. Yeah. I just... It's in the plan. It's in the plan. Yeah. It is. The road, the road coming out where the roasters are, it's already there. It's there. It's already a plan for it. But the, I will, I think there is the expertise needed to design a commercial zone and design the, it's the current, uh, attitude towards buildings that I don't think we have that expertise from. No. No. But a committee made up of, what's the thing? What's the city? It's a committee. I'd be more comfortable with this. Select board zoning board economic development committee. Weyland housing partnership, finance committee, department of public works. They're not going to do it either. Yeah. Oh, right. Public works might be helpful. Is that what's, is that what's listed on there? Yeah. As just suggestions. Yeah. No, this is the following committees and boards. Um, the task force should be comprised of nine voting members appointed by and serving at the pleasure of the select court with seven appointees to be members of and or designated one each by the following committees and boards. And two citizens of the town for at large positions with no criteria. Or deliver a loan. I'm not sure what's being delivered. Recommendations. That's what happens a lot of us around, you know, and advise on an RFP. Yeah. Yeah. They want to hire a master planning firm. And that's not what I don't think. So you said master plan firm, which is different than the task force for group 12. The task force is to recommend a master plan firm. If we have more group 12. Right. And then to work with that person and then come up with a master plan. Oh, that was a piece that. I think. Isn't that what it is? It ain't no leap of shit. It was definitely talking to us. This is finalized plan with the firm. Right. We're finished. Right. But that's not necessarily not working on this. Well, we just told them we've been working on it. I mean, I brought actually minutes from each of the meetings where we were working on it. But the thing is, I mean, isn't the master planning firm, isn't that basically, that's what we got from baby. That's right. We already have that. Right. Isn't a master plan a specific document that you already have. Yes. For from 2010 or so. It's like 40 pages. Yes. It covers the whole town. Right. Okay. And then we can have individual. We're allowed to. Well, we have individual areas. Yes. Yeah. And we have done that in the past. We have done the town center area where the town center. But this is a master plan for. 20. All right. All right. But Tom said that really wasn't a master plan. But I don't know. Okay. So I think we're all on the same page. I think that Robin's suggestion and Jesse's suggestion and all of yours would work if we could get it much more focused and people with real expertise. If we're going to have assistance from others. Yeah. Not just somebody who is there. Yeah. I keep going back to, you know, what would be amazing was if you've got some like Kennedy School and other related students who are looking for summer project and some law students who are interested, you know, government work and legislative drafting. And they worked on something like that. That's in my neighborhood. Yeah. Yeah. Yeah. You know, if we had a small group who worked on it for the summer. Yeah. They would probably get us. They'd give credit for it too. You know, and jobs are hard to come by soon as well. Is that at one point? It would be if there's TELPS that's kicking around. And then there's also UMass Amherst. So there's the providers too. But those are not summer. That's like fall to fall. Yeah. But if you could get a group of them to work together on an internship. And go through our existing zoning. Yeah. The master plan that we got for beta. Try and figure out how to fit all of these things together. Yeah. Maybe that's money together. You can pay them. Yeah. There's no few jobs for those kids out right now. They can work for free to put it on their resume. Is that illegal anymore? For governments it is. Yes. I've done free jobs for them. Two to my office. And, you know, it's something they can work on together virtually. They don't have to get out of their pajamas to do it. Or if I can like a vocal idea. Rachel Bratt does teaching. Oh, yeah. I don't know if she can use it anymore. Not anymore. She did. She might be able to help us something like that. Also, what's her name? Constance. Not Constance. Candace. Her. I can't remember her last name. She was on the House in Park. Yeah, yeah. I think she's retiring as well. But she knows. I don't know what the disciplines are that they have at the school where she is. I think she's at DC. But she could also help speak through that. Okay. Would Bill Sterling be worth asking, even though he's not connected to a school at this point? I think so. I think we want a bunch of young people to really like plow through it. And I think we want people who have some like legislative and regulatory at least reviewing and contemplating those sorts of issues. You know, people interested in being town planners. Things like that. Yeah. Andrew. Yeah, I know. Andrew doesn't have the time. But he was great. He was. Yeah. Andrew. Yeah. Andrew. Yeah. Andrew. I wanted to think of that. Any options to get some people. Yeah. Andrew. Right. Andrew. Andrew. I'll just always look up to. Yeah. So anything else. Are they going to sit down for them? No. I'll see you. I'll see you Wednesday. Yeah. I'll see you Wednesday. Yeah. We have meeting Wednesday at 7 o'clock. I'll see you. I'll see you. So you can see your PJs. For the excursion. Yeah. I got back for it. I thought Wednesday wasn't. This week. Yeah. I sent you a note. Over the weekend. It's probably in my calendar. Okay. Let's look at the. I mean, I sent you a note to look at the draft decision. Okay. So you. I sent you a note. I sent you a note. Over the weekend. Probably in my calendar. I sent you a note. I sent you a note. I sent you a note. I sent you a note. I sent you a note. I sent you a note. About something. Sure. So. I want you all day on it. I'll look at it again tomorrow morning. I had already sent you to. But I'll look at it again tomorrow morning. Yeah. But the changes you need to be personally. So. Well. Put it back there. Yeah. For a good discussion. Put them in incorrect changes. Yeah. I love it highlighted. Okay. Whatever. Honestly. It's all highlighted. Okay. It's kind of limited stuff too. And when it's not my name. Not you. It's left over from the last version. Yeah. Yeah. Oh. Yeah. Not my blue comment. She asked. She asked. If it's okay. To the tap manager. Should make sure. Make sure. That you've got all the information. That you've got all the information. That you've got all the information. That you've got all the information. Now. To see. Yes. Yeah. Right. Is the compete church ever the point? Yes. Yes. Are you ready for motion? Yeah. I. I know to address. I'll start. I won't figure. Raise your hands. Five zero. Great. Thank you so much.
