The agenda for this evening is, uh, public comment, then review and approve draft minutes of 7-22-26. Then, uh, continued public hearing on PB-2601, 1 Hobbs Road, uh, formerly 67A Loker Street, Oak Street. Management Support of Living Residents Site Plan Approval, then at 8-15 review and approve draft Planning Board Annual Report, uh, and then at 8-30 review the draft regulations that Robert put together on, um, Accessory Dwelling Units and Outdoor Dining at Restaurants. Then any updates from the Town Planner and Chair, uh, Board Comments and Concerns, and then adjourn. So, is there any public comment this evening? Uh, I've seen no, they're hand-raised. I guess the tape doesn't know.

Um, we can, uh, we can't start until 7-15. Uh, so, let's... Okay. So, let's do, um, have anybody, have you guys had an opportunity to review the Draft Planning Board Annual Report? I looked at it quickly. Ira? Um, I skimmed it, yes. So I guess the answer would be no. Um, do you want to go over it in more detail? Yeah. Also, I will give you a clip note to what it is. It's pre, pre-standard. Pretty standard of nothing special every year, pretty much the same thing, has who's on the board, um, if there's a time difference of people leaving the board or coming on the board, that is indicated, town staff. Uh, purpose and duties of the planning board, that is pretty standard, uh, and then it gives you a summary of, it's breaking down between approval not required, subdivisions, site plans. Just giving someone a, a snapshot of what the planning board does. Okay. All right. So the planning board did that within the last year to, uh, the residents. And then it talked about the goals at the very end, and these are the goals for, uh, fiscal year 27. That's for next, this coming year. Correct. And so that is it. It's nothing special, but it does give someone a quick read if someone wanted to really understand what the planning board does or is new to town, they can kind of get a synopsis of the last year, um, in a cliff note version. So. And the chair did review this. Um, I drafted it in the chair, the plan, which are, um, did review, you know, Annette Lewis did review this. So, and this is, I believe this is due at the end of next month. So. I do have, um, just a few minor suggestions, um, on page two at the top after Terrell school, um, I would take out. Stop. Starting with the colon, I would take out the underlining through lot, um, then enter site plan review. The first one after, um, the name of the church, uh, where the colon is at the end, just delete the underline there. It's a really minor, but I will say that again, I said again, just delete the underlining under the colon. Oh, okay. Just to be consistent throughout the document. Yep. Um, let's make sure that no, nowhere else, I didn't, nobody else shared that as a pet peeve. Pardon me? I didn't know anybody else shared that as a pet peeve. Thank you. Well, I'm glad somebody else thinks it's not, it's something to talk about. Um. Okay. Then in the, um, the there on the last page under appeals of the planning board site plan decisions. I thought that was a little rough, Robert, um, I'm going to read what I think might be an improvement. Uh, and then I'll do it more slowly if people think it's okay. So this is appeals of the planning board site plan decisions, the select board proposed amending. The site plan by law, uh, period, uh, the planning board recommended, excuse me? The site plan site plan by law, and that's not period the select board proposed amending the site plan by law to allow an earlier timing for appeals of planning board site plan decisions. Period. The planning board recommended against approval because the amendment would create more confusion than clarity period capital at town meeting comma, the select board move to postpone the measure indefinitely. That's fine. So should we do that slowly?

And then we'll get back because we went away like three more minutes. I will give you a snitch a snap of next week's we have two weeks I send you as the packet, I will be on vacation. So I got the agenda done. Right now the agenda has been posted if if man chair finds this something needs to be amended, she will amend that with the town clerk. But as for now, I mean, nothing, the the public hearings will probably go on. But if there's some kind of update that comes up next week, the chair may may may amend it. But for now, it's gonna be a little shorter. We have two public hearings. One is about the Castle Road pump station for the water district for the MRWRA. And the treatment, the Happy Hollow treatment, this Happy Hollow treatment traffic that was called. That's one public hearing. The other one is for the amendment to the mixed use overlay and site plan phase two of the town center. And those changes will be discussed before with with the owners include signage, the use of the fields, the closing of all the staff. And maybe that was it. We have like three changes. Yeah. So those are the things that the for the board to discuss. One or two meetings might take two meetings. And kind of flush out all the ideas. But those are the ideas that that they have been the town center has discussed with the planning board, and has discussed with the select board in the past two months. So then we have a continued hearing today for Oak Street management. And we will we can have a discussion about that. But ahead of time, they have asked for a continuation from today's hearing, which turns out might be actually a good thing. We're talking with two members of the board not even being being present. So if if the vote goes down, we're missing one or two people that we may need him to vote. I didn't understand what you just said. We if it if we're dealing with a special permit, we may need him to vote if Bill Yes, somehow, if Jesse or Bill or someone else is not available, right? Okay, members of the of the planning board. So I first I want to thank you all for your patience on our project. We are requesting a continuation of our meeting to the the next meeting. I'm still working on the lease agreement, which we're working on to the next September meeting date. We're still working on the lease agreement with the nonprofit organization. I believe that we have successfully submitted some additional information with regard to the site distances that we have been talking about last meeting. And like I said, we are in process of working with some funding sources working with D. D. S. Um, and we'll also be, um, submitting applications and requesting, uh, you know, see what, uh, the, uh, Wayland municipal housing trust, uh, may have available.
Matt, um, I'm going to speak for myself and then, uh, Paul, the board, my concern is that we've been continuing and continuing and continuing, and technically you shouldn't be appearing before us now. Um, and for me, I would be willing to offer you two options. One that you tell us by when you're going to have the requisite documents to show that you're eligible for Dover, and then you'd submit those and, um, we would be having a hearing after that, but we'd have to know now what that date would be that you were shooting for. Because. Yeah. It really messes up our schedule among other things, uh, planning to have a real meeting with you and then not being able to, uh, also, it doesn't look good for us to continue dragging this out. That's one option that I can think of. The other option is that you can withdraw without prejudice. Um, and if you came back within. A reasonable time, say six months, um, that we wouldn't charge you again for the application, uh, but I'm not, I personally am not comfortable with just, uh, postponing from meeting to meeting. And how does the rest of the board feel about that?
Um, I, I think those are good options. Um, I mean, if Matt has some idea about when they're definitely going to have a lease done by, then that's different and we can kick the meeting. Meeting out until then and, and sort of pick it up that way. But if it's just, if we're just gonna be kept on hold until there's a lease agreement, that, that is hard for us. How about you, Ira?
Can you give us any clue as to when that lease agreement might, uh, be obtained? I mean, I, I agree with what Robin said, if you could say, okay, here's the month that I think I need to work on it. And, um, that'll give us a heads up as to, you know, we don't want to keep scheduling this thing. She's right about that. But, um, I, I, I guess I think the withdrawal, even without prejudice, it may be a little drastic if you feel that you're going to get this together within the next couple of months.
I, I do expect certainly the next couple of months. And I, I believe by the September, uh, meeting date, we'll have all of those, uh, you know, documents, you know, formally submitted. Uh, Mark Lanza has been, uh, working on this. Um, and I believe, you know, in speaking to him that, that we should be able to have it completed, I apologize. We're not able to submit it in a timely manner, uh, prior to this meeting. Uh, but the, uh, next meeting. You, you have, You've been negotiating with the ARC, and you have a contract that you have? It's not the final, but you have been negotiating with them? Yes, not the ARC, correct. Oh, it's not the ARC, somebody else. Correct, that's correct.
So I'm uncomfortable moving it to the 23rd, just because it seems short to me. Okay. It's less than a month, and we want to see the documents at least a week before the hearing. True, true. I forgot the meaning, I was assuming after that. October 7th. Yeah, October 7th and October the 21st. And again, this would be, for me, my own thoughts are, this would be the last time I would be willing to give an extension. If we're not moving forward. October 7th seems pretty reasonable, because that gives the Matt and the team over a month to, you know, an extra two weeks after September 3rd, enough time. If we can just, if we can continue, well, if we do continue October 7th, we will also need a continuation of the deadline. Right. Which I can get after I come back from vacation. The other thing we would need, we would need a deadline. Of when we, if we're going to do this, when we get the, when the town actually receives it. So October 7th, if we're going to, if we're going to continue. I don't want you to decide that date, Robert. I want Matt to confirm that that is a realistic date and that he will be ready. If he has any concerns that it might take longer than that, I want to go to a longer date. Well, why don't you. Why don't you. Try to find that end date with Mark, right? We have to decide today. Right. At the hearing. Can you, can you text him right now and find out what, if he could put an end date to what he's working on? Yeah, our prior discussion was September. I will text him.

And so there's October 7th, no, October 7th is a predetermined planning board date, correct? Yes, yeah. And the next meeting after that is the 21st. And again, we need the materials at least a week before. That's right.
Robert, in the meantime, can you get the traffic report thing ready to put on the screen? Sure. Or maybe we can do that now while we're waiting. We're waiting to hear back from Mark. Yeah, that would be great. Yeah, my understanding was that the kind of loose ends were, you know, it, a comment on the traffic, and then also the lease with the last remaining items. Okay. And the Conservation Commission, last we heard, they were waiting for us. And we were waiting for them. Okay. We were waiting for them. So. So that, you know, I feel like I can't control that. You know, I could. Well, I didn't know if Robert had been able to speak with Linda in the meantime. Well, she's been on vacation the last few days, so I'm going to catch up with her. So. It's not. It's not resolved yet. Why? Yeah. So I guess I would comment, you know, kind of pending, I guess, whatever that. Did they have any concerns, though, or were they pretty much okay? My understanding, again, is that they're telling us they're waiting for planning, you know, planning board decisions. Right. Which is why we did this straw poll the last time we met, because we wanted you to have a sense that we think it's a great project and we'd like it to go forward. And my belief and understanding is that the Conservation Commission does not have any great issue. They have been bringing up different things, but I think that they're really ancillary to actually giving us permission. I don't think they. How would I? I don't think. I don't think they, you know, necessarily want to, you know, say that they're waiting for planning board. I don't know if that's. No, I think that I think they said that to Robert. Okay. So that is okay. Okay. Yeah. I think that's my understanding. That's what I'm kind of getting, you know, as the biggest issue there. Okay. Thank you. Did everybody have an opportunity to read the sightline evaluation? Yes. Yes. Do you guys have any questions? I guess I have questions with, I mean, so is this evaluation recommending that the speeds be reduced on the road and that a stop sign be added? No, it's. Oh, I read it. Oh, sorry. So it's, it's that there is a stop sign and there is a posted stop sign. And there is a posted school zone speed limit. Oh, okay. So then all they're recommending is the removal of vegetation. That's correct. That's correct. And we did talk about pruning up the trees in that uphill area. So these are the questions that I have. It is definitively on Alden, Hobbs and Locher, 25 miles an hour. I can't. I can't tell because I've never seen a report presented this way. Normally they have a picture. They show you where the stop sign is. It's not on any of your plans at all. So we'd need to see something that shows where the stop sign is. And. I, you know, it needs to say the posted speeds on these streets is. Which it doesn't. It just says regulatory speed. And then it's got. Little footnote. And then on the eastbound. It says. That they're assuming that's from a 15. Foot. Distance. If you look at the bottom footnote. Yeah. Not anything else. So I wasn't sure if in fact. It complied with the AASHTO standard. And the fellow, whoever did this needs to give us some. Words. So that we understand. I mean, he said that there was a stop sign, but so what people can go through stop signs. If they're traveling. And, you know, I don't know what the normal speed is. There's a posted speed. And then there's the speed that 80. I think the term is 85%. Percent. Of. The vehicles travel at. And that's generally more than 25 miles an hour. It might be. That you still have sufficient sight lines. But I can't tell. So. To clarify. So that. Point with regard to the actual. Speed. On those. Three. Roads. You would a comment. On the. Speed. On the. Speed. Of. A. Road. And then. You would a comment. Be sufficient. You actually want. Some kind of. Physical. Yeah. Normally. They would. They would. Have a diagram. That shows the intersections. Of those. And arrows pointing. In each direction of travel. With a speed sitting right on it. Robert can probably send you a sample. From one of the other reports. Okay. That would be helpful. And. More of an explanation. Of why. On the eastbound side. He only goes down to 15. Miles per hour speed. And show where the stop sign is. And you can certainly submit that ahead of time. So that we can look at it. That would be great. Yeah. That's. I mean, it's. This is helpful, but it just. It. It doesn't slam dunk it. Okay. Okay. Shows down to. Miles per hour. Okay. Okay. So that. The, the. Again, I apologize. The 85%. Wouldn't require like a traffic study or some. Somebody. I mean. It doesn't. Necessarily need to have a traffic study. You could just. Have. Some. You know, You know, You know, You know, You know, You know, You know, You know, You know, You know, Staff could just. Have someone. Sitting out there with a counter. Or, You know, Approximate. But I, I don't think that 25 months, Assuming that people are driving it 25 miles an hour. There is realistic. Well, and, And. You could read that to say that they're relying on people going 15 miles an hour on one street. And that is definitely not happening. Right. And he says, that's because. but we can't see in the plans where the stop sign is and i don't know if that would be true yeah it would be good to see a diagram

this is kevin dandrade kevin dandrade's forms this is chaos school so here's the table it's supposed to be average and then here's the average speed observed and then maybe you could just send him the whole report they can pick this is i think this is pretty concise through it it's a pretty uh these are this is a nice detailed study um so i'll start right now so don't forget right and you don't have to produce the whole thing we're not looking for that we're just oh i'm happy to yeah i would even call you know the uh the company uh you know make a request you know if they could you know give us one i mean certainly that's something you're familiar with and is acceptable so what happens but again we're not asking you to do a major traffic study we're only concerned about that driveway yep and sight lines that's it okay and the other ones were really concerned with traffic in the report that you're going to be looking at the sample the issue was really traffic not sight lines okay right so only that driveway and and sight lines omit you know the traffic aspect of it right okay i mean i think that's what we agreed to before isn't it everyone yes thank you i don't want to be speaking for the board yeah no but i mean this the speed comes in in terms of the sight lines but the other one is more of a flow issue so right we're not concerned with that yeah so focus on the sight line sight lines and speed right from that driveway opening speeds

again the board when we did take a straw poll was really um very enthusiastic about your project and we don't want to make life difficult for you but no no we uh we want to bring it to conclusion of course of course i i i and again i appreciate your your uh you know patience on this um yeah so that's and i've been in your direction guidance you know really is very much appreciated um so i will make you know the team aware of that specific issue um also a touchback base uh marcus
do you need to call him rather than just texting him um i could try that he had texted me earlier today and asked if we could i asked him to be in the meeting but he had a conflict oh and he had asked me prior um if he and i could catch up tomorrow i don't know what if he is at all even available i had requested um okay but my last you know conversation was that he and i would touch base tomorrow um one of i mean we could just pick an outlying date that would give you the time to get your um contract done and signed i mean if we're if we picked like october 21st and you were ready to come in sooner you know you could always ask to get put onto a sooner meeting if we haven't booked the meetings up i don't think we can you can't go you can't go back now okay so if you do october 7th and then they come back like we need more time then you can you could continue beyond that yeah that's what we're trying to avoid yeah yeah once trying to say that i you know and again i appreciate you know i very much appreciate um um you know what you guys have been helping us with here um you know i you know i've been accused of being an optimist but i i i would believe you know that you know i was my initial impression was that we would be ready for the september meeting um uh certainly you know obviously i think that we could be ready for the october meeting um i don't know how especially with kind of the you know uh added detail that we should have uh that i should have uh uh you know forecasted and provided uh with regard to the driveway opening and the uh sight line uh you know uphill there um let me ask you this yeah um how far along are you in your negotiations uh very far along that's why i was saying that that the i was hoping to have it um already okay um because the 23rd of september is only a month and that would give you three weeks because we want it again at least a week in advance so that would give you three weeks which again to me seems tight seems tight yeah from three weeks and then but you know
in october the 7th is you know just not that much after that
and that would give you you know about even a four-week period to go back into it okay so that means so your regularly scheduled meetings would then fall again october the 7th and then october the 21st 21st great

And then, you know, then understanding, you know, we would, you know, have to make a, you know, decision. Certainly we'll be meeting, you know, our, on our side, we'll be, you know, meeting prior to that multiple times and say, look, we've got a, and I forget the terminology, but cancel it without prejudice, did you say? It's withdraw without prejudice. Withdraw without prejudice. I'm not, I'm not real excited about that. I'd rather just get it done. Nor am I, or anybody, you know, and everybody else for that matter. But yeah, so, but I'm going to certainly voice that that's, you know, the intent and with.
Okay. And without prejudice means that I can come back at a later date. Right. And would that allow us to kind of start where we left off or would we have to kind of. You would just submit all the same materials again. We could do that. And, and we could take the record that we already have, I think, and work from there. May I ask a question from personnel on the planning board? Is there, are there a new regime coming in within that? No, we're here. We're here until I think April. Okay. I know that that's, I've seen that on the, on the conservation side, a lot of change.

Next thing was the special permit. Yeah, relation for 80 years. Yeah. So this is concerning now that we checked modified the requirements pending ages approval, which I've not received yet. This is just pending that we probably be good practice. So we have to create our own rules and regulations for this. So we have to run file for when someone applies. I do not believe currently today we have any kind of rules and regulations for any kind of special permit. Probably the only thing we probably would have is for me potentially like an aquifer protection district. But I think it'd be good practice that gives be a give someone a rules or regulations that would be according to a specific rules or kind of special program than just generic. So it kind of follows the same kind of patterns of other rules and regulations, explaining what it is, giving applicability what it is referencing, giving up setting the fee schedule, providing some definitions. The process of what happens who, how many copies and you need to submit what do you need to submit? Explaining what you know, what would be in equation submission? How do you withdraw? What application public notifications? And if you need to get the play on any time can modify or modify the regulations. I have drafted this in the past, the other rules and regulations that have cited that the plan board must post for a advertise meeting to modify the rules. I have drafted that the plan board at any meeting could modify or amend this. And that is just so that it's not as heavy to make a modification, knowing that this is specifically that that once you mend it or change this, the plan board, that unless I'm dramatically changes, or something is completely wrong and even modify, I would not suspect this will be changed much in the future. Unless I'm unless I'm crazy happens. And there's something that's completely wrong or but I don't think this is something that's going to be modified over and over again. So happy to answer any questions based on this. I don't really understand the last point that you made. Are you saying that we could make changes to this if we needed to and not post? Okay. Back to updates from Town Planner and Chair. Did you have anything, Madam Chair? I wanted you to talk about the Suffolk people and the work on the Route 20 project. Oh, that sounds good. Yeah, that's one thing. Start with that first. So in the past, in the last six months now, the town has gotten a gift fund of 60,000 hours from a project that Suckboard within the last few months have appointed that 20,000 hours. That's a lot of money. Yeah. That's a lot of money. Yeah. That's a lot of money. Yeah. That's a lot of money. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. I think August 31st, I would follow up with Michael to make sure that they actually do vote next week. But that's what he said to me, that they were going to vote. And I told Robert that I didn't really want to pre-call. I thought it would include having a law firm as well. I believe these people, we don't have to pay. It's part of their coursework. And, you know, we still might need assistance. And as Robert said, he reached out to a number of law firms and hasn't heard anything back. I put a list together of people that I've dealt with over the years, just friends kind of people. Not that they would be doing the work, but I thought I would reach out. And see if they knew of any youngish lawyers wanting to start doing things like this. And if you know of anybody, Robin, that would be great. I know. The wrong line of work. Is there the students from Suffolk, is there any interest in a faculty member in sort of working with them and supervising them? No, they'll be. Oh, good. Okay. Yes. Absolutely. Absolutely. We need sort of oversight. The part that I'm going to talk to you is. We read some of the people who work on them or someone else that be that, you know, started the process. And so, yeah, at this point, what we need is that select board to give the thumbs up. So we're not working without their, you know, blessing. And then we probably we need some kind of we need some civil work from Suffolk law to work on this project. So, right. Some kind of a meeting. And we have that outline that we put together. That we spent a lot of time on as the core for to start drafting from that's one thing. And then I have been working on trying to get authorization. So we have the clean energy information sitting permitting. This is for solar panels. And there's a new whole new process that needs to be done conducted by the town. We have a local official. And yet when you have a sore ground matter, so our project someone comes in. Then you have. You can talk to who sets up view the application, sets up all of the information and sets of all the discussion with different view committees. I've been working out with the select board and trying to get that done so that the select board has indicated who the local official is at this time. They still have not done that. So I have started also working with and reached out to NBC, the local regional has the regional office. And they have offered support to help us write eventually rate the ground matter solar by law if we choose. It sounds great. So I have had that meeting with fellows from from the NBC. I had Olivia sit in so that it was not just me making a decision. And Ellen from from the Energy Climate Committee is also supportive to try to get this done. So at this point, it's. The point is. Is there anything else for updates? I went to the housing partnership meeting. You know, they've got things they're working on. Good Shepherd seems there's no update. The housing production plan they're working on with Robert and Anina and everybody. I have an update on that, too. Yeah. And then so they wanted to talk about how to encourage people to build ADUs. I'm not sure there is a way to do that. But, you know, I did suggest that maybe they should see if the Board of Health is interested in, you know, just suggesting to people when they're getting approval for a septic system to say, you know, just so you know, if you ever want to build an ADU, you could over-design your capacity so that you could build an ADU later on without having to go to such an expense. And so they were going to write to the Board of Health and just suggest that they, you know, if somebody comes in and they said, you know, by the way, you could consider adding capacity so that later on you have this option. And they liked that idea, so they were going to follow up on that. And then they would like to have a meeting with Mr. McCall and the planning board about suggesting, you know, that the town reduced lot sizes and allow alternatives to septic systems so that people can build more houses closer together. Like what would they use instead of septic systems? There are some other sort of, I don't want to say crunchy, but there are some other alternatives. That are approved by MassDEP? I don't know, but they want to talk about it. And I said they... They should, you know, they wanted to meet with us first. And then Mr. McCall and I said, why don't you just schedule one meeting where we're all there? We can do it quickly and move on. Yeah, I would suggest to them that they check with their alternates. Yeah, supposedly these things do get approved in other places, but they should run it by the Board of Health. Actually, they should invite the Board of Health to the meeting too, so. Yeah. But anyway, that's what I have to report. When you say in other places, in Massachusetts? Yep. Really? Yep. They've been pretty picky over the years. Yeah. No, supposedly there are some alternatives. She was supposed to send emails to the two proponents asking four different questions to both of the proponents and then get back a response to each of them. She left and didn't send those out. So we sent those out, and then we were getting responses back by Friday. And then when we get back from vacation, we're all going to meet to go review those and then finally choose someone. So it got different. Yeah, because they mentioned you're... You're sort of past your deadline, so you have to wrap it up. They got past the deadline by a month, which is not a deal. So it went a little faster. But hopefully those responses will be helpful for us in the... Making a decision. The numbers that we're revealing. Okay. So I felt like I contributed. Thank you. This has not come up yet, but it will come up very soon. The ZBA denied a project for a special permit, which they didn't give the applicant the chance to withdraw without precision, which they should have, but they didn't. Otherwise, anyways. There's a statute in the Master of Law that allows an applicant to reapply within two years if they can show and get approval from the planning board and the ZBA that the project that they're proposing is essentially different than the project that they got denied. So for this project, there is a single-family house on non-conforming lot. They are going to, in the next few months, reapply and submit to the planning board and the ZBA. And the planning board and the ZBA must make a determination that the project that they are submitting is different than the project that got denied. And we have to agree, I assume, that the project they're submitting is substantially different. Correct. You're not approving the project. A lot of people. You're not denying the project. You're just saying, approving, you're just agreeing that this project is different. I've seen what they propose. It is different. But I have also asked them to really spell out. Here are the differences. Here's the floor plans, why it's different. Here's the renderings of why it's different. Really give you all the information so that to you it's very clear or not clear that it's different. That is a statute that I've never seen before, but we've asked town council, and I reviewed it, too. It is in the statute, but the bar is very high, too. It will require a supermajority of the board to vote in favor, or not vote in favor, but vote in agreement that it is. So the differences, in order to be substantial, do they have to be differences that have to do with the reason it was denied? Like if it was denied because it was, this doesn't make sense, but it's the only way I can get this. If it was denied because it was red. And instead. The difference is that they added a window, but it's still red. Is that a substantial difference? I think what you're looking at is size, height, massing, things that would determine, like, yeah, this is a different house. They changed the R-TAC to who it is, so they completely got rid of the R-TAC that they used and got someone brand new to come in and modify the project to show that it's different. Okay. But. So I'm saying, so if it was denied because of the height. And what they did was they changed the massing, but not the height. To me, that's not a substantial difference, perhaps. Is there any guidance on that? On what substantial? There's no real guidance on it. There's case law, but there's no guidance on exactly. We might need some. Yeah, we might need the case law, too. Yeah. I mean, I have the case law. Yeah. Okay. Perhaps share it with us when you. Yeah. But I mean, it would be based on the height, the size. The issue they had was how much square footage it was. I originally gave the ZBA or wrote up a did a quick model of the neighborhood and showed that the house proposed house is much larger than anything in the neighborhood. And they ZBA used that they modified once and then eventually the ZBA just denied it. And the applicant would like to come back in within the two years to redesign the project. So they have they have their work cut out. They need to really convince the plan board and the ZBA that it's a complete different proposed house. And I think that's the dream right now is to really to put that together. So I will be on the agenda once we have an idea and they will have to provide some further information and narrative to explain exactly why. So. But that's coming down the line. I would expect that coming in within the next month or two. So just be ready to really it's a really weird request, but it gives the applicant the chance to come back within two years so they don't have to wait it out. Robert, the scenic road thing. Do you want to brief the board on that? I think it's been resolved, so I'm not really. Well, I want I want the board to understand. So I'll. Now, there was a request from someone about a. Cut doing a new curb cut into a scenic road on plane plane road. I think it was playing doesn't make any difference just to scenic road. Yeah, it's in a road I discussed it with the app. The app can provide a request. I discussed it with the DPW and according to him, I was not aware that it would not be allowed and that circus in the past, the previous town planner allowed it under some provision. Before we posted or did anything or collected any money, money or did anything, I just discussed it with the chair and it was determined that it would not be allowed. You can't have two driveways on any kind of scenic road. So how does happen in the past? The bylaw was modified in the nineties, so if anybody came in before that, then they were fine. But after the nineties, if this one someone if someone did a second curb cut. Then they did it with not their correct permission by the plan board, because the plan board deals on the same road is stonewalls or a star trees. And that's the need of this request so that it will not become a friend. The way the bylaw reads is that you may only have 1. Driveway cut on a scenic road. Per lot, they already have a driveway cut. The gentleman said he didn't feel like it was. It was safe and he wanted to have 2 ways out and and if you look at the bylaw, it says that the planning board can hold a hearing for for dealing with trees on a scenic road, or if we're dealing with stone walls on a scenic road, that's all. It says, so we don't even have the ability. To deal with it, I wasn't aware that circus did that. I have no idea which houses. He may have done it for and it did not go before the board. I'm sure because it's not provided for, and I don't remember ever seeing them. And I actually always watch that because I think it's important to have 1 curb cut on the scenic roads. So I, I told Robert that I just didn't think that we could even have a hearing because I didn't think that under the bylaw, we could address it, that the gentleman could go to the DPW. And. Change his curb cut, he could choose whichever 1 he wanted. And, you know, that would be fine and he'd have to close 1 and open a new 1. But I want everybody to understand those things because. It's disturbing to know. Or to think that a prior employee of the town. Would have violated the bylaw when it is absolutely clear what it says. Okay. Yeah. We have petitioned at the last time meeting to add code to the legislature and ask for more liquor licenses. The state has asked us to create a map of showing where we would like to see up to 10 liquor licenses be presented. We provided the state and provided them feedback of here's what we're gonna do. And most of it was based on the town center, Route 20, and the roadside business area, which has leaf farms, because they also are potentially thinking of something. This would only be for a full liquor license. It would not be for beer and or wine malt. We have those licenses, but it doesn't quite affect the planning board exactly, but this is also any kind of new site plans or business in the future, this would be affected, you know, having the correct resources in our back pocket in case, you know, sending a town center. Right now, there'd be no full liquor license for the town center, if the town center wanted to bring in. You mean no extra ones? No extra ones. Not that they would. I was gonna ask if you were discussing this because you thought that the planning board and the members needed more places to go drink. Well, I mean, we're looking at the town center and they are bringing in new businesses. Yeah, they're trying to, yeah. There's a new, they announced a new business today. If you can find it online, there'll be a new ice cream shop coming in to Wayland Town Center, so. Great. New City Creamery has announced today on the Instagram that they're moving from Sudbury to Wayland. And so, wow. Next spring, we should be having an ice cream shop. People are asking where's, and like, I don't know, where in the town center, somewhere in the town center. So, we're following it in ice cream shops, but I think they are looking at bringing some more new businesses, new restaurants in. With Terrain coming in, you know, starting today, people are gonna need places to have rehearsal dinners and stuff like that. Yeah. How was Terrain today? Mod. Was it really? Uh, purpose and duties of the planning board, that is pretty standard, uh, and then it gives you a summary of, it's breaking down between approval not required, subdivisions, site plans. Just giving someone a, a snapshot of what the planning board does. Okay. All right. So the planning board did that within the last year to, uh, the residents. And then it talked about the goals at the very end, and these are the goals for, uh, fiscal year 27. That's for next, this coming year. Correct. And so that is it. It's nothing special, but it does give someone a quick read if someone wanted to really understand what the planning board does or is new to town, they can kind of get a synopsis of the last year, um, in a cliff note version. So. And the chair did review this. Um, I drafted it in the chair, the plan, which are, um, did review, you know, Annette Lewis did review this. So, and this is, I believe this is due at the end of next month. So. I do have, um, just a few minor suggestions, um, on page two at the top after Terrell school, um, I would take out. Stop. Starting with the colon, I would take out the underlining through lot, um, then enter site plan review. Okay, members of the of the planning board. So I first I want to thank you all for your patience on our project. We are requesting a continuation of our meeting to the the next meeting. I'm still working on the lease agreement, which we're working on to the next September meeting date. We're still working on the lease agreement with the nonprofit organization. I believe that we have successfully submitted some additional information with regard to the site distances that we have been talking about last meeting. And like I said, we are in process of working with some funding sources working with D. D. S. Um, and we'll also be, um, submitting applications and requesting, uh, you know, see what, uh, the, uh, Wayland municipal housing trust, uh, may have available.
Matt, um, I'm going to speak for myself and then, uh, Paul, the board, my concern is that we've been continuing and continuing and continuing, and technically you shouldn't be appearing before us now. Um, and for me, I would be willing to offer you two options. One that you tell us by when you're going to have the requisite documents to show that you're eligible for Dover, and then you'd submit those and, um, we would be having a hearing after that, but we'd have to know now what that date would be that you were shooting for. Because. Yeah. It really messes up our schedule among other things, uh, planning to have a real meeting with you and then not being able to, uh, also, it doesn't look good for us to continue dragging this out. That's one option that I can think of. The other option is that you can withdraw without prejudice. Um, and if you came back within. A reasonable time, say six months, um, that we wouldn't charge you again for the application, uh, but I'm not, I personally am not comfortable with just, uh, postponing from meeting to meeting. And how does the rest of the board feel about that?
Um, I, I think those are good options. Um, I mean, if Matt has some idea about when they're definitely going to have a lease done by, then that's different and we can kick the meeting. Meeting out until then and, and sort of pick it up that way. But if it's just, if we're just gonna be kept on hold until there's a lease agreement, that, that is hard for us. How about you, Ira?
Can you give us any clue as to when that lease agreement might, uh, be obtained? I mean, I, I agree with what Robin said, if you could say, okay, here's the month that I think I need to work on it. And, um, that'll give us a heads up as to, you know, we don't want to keep scheduling this thing. She's right about that. But, um, I, I, I guess I think the withdrawal, even without prejudice, it may be a little drastic if you feel that you're going to get this together within the next couple of months.
I, I do expect certainly the next couple of months. And I, I believe by the September, uh, meeting date, we'll have all of those, uh, you know, documents, you know, formally submitted. Uh, Mark Lanza has been, uh, working on this. Um, and I believe, you know, in speaking to him that, that we should be able to have it completed, I apologize. And again, this would be, for me, my own thoughts are, this would be the last time I would be willing to give an extension. If we're not moving forward. October 7th seems pretty reasonable, because that gives the Matt and the team over a month to, you know, an extra two weeks after September 3rd, enough time. If we can just, if we can continue, well, if we do continue October 7th, we will also need a continuation of the deadline. Right. Which I can get after I come back from vacation. The other thing we would need, we would need a deadline. Of when we, if we're going to do this, when we get the, when the town actually receives it. So October 7th, if we're going to, if we're going to continue. I don't want you to decide that date, Robert. I want Matt to confirm that that is a realistic date and that he will be ready. And my belief and understanding is that the Conservation Commission does not have any great issue. They have been bringing up different things, but I think that they're really ancillary to actually giving us permission. I don't think they. How would I? I don't think. I don't think they, you know, necessarily want to, you know, say that they're waiting for planning board. I don't know if that's. No, I think that I think they said that to Robert. Okay. So it's, it's that there is a stop sign and there is a posted stop sign. And there is a posted school zone speed limit. Oh, okay. So then all they're recommending is the removal of vegetation. That's correct. That's correct. And we did talk about pruning up the trees in that uphill area. So these are the questions that I have. It is definitively on Alden, Hobbs and Locher, 25 miles an hour. I can't. I can't tell because I've never seen a report presented this way. Normally they have a picture. They show you where the stop sign is. It's not on any of your plans at all. So we'd need to see something that shows where the stop sign is. And. I, you know, it needs to say the posted speeds on these streets is. Which it doesn't. It just says regulatory speed. And then it's got. Little footnote. And then on the eastbound. It says. That they're assuming that's from a 15. Foot. Distance. If you look at the bottom footnote. Yeah. Not anything else. So I wasn't sure if in fact. It complied with the AASHTO standard. And the fellow, whoever did this needs to give us some. Words. So that we understand. I mean, he said that there was a stop sign, but so what people can go through stop signs. If they're traveling. And, you know, I don't know what the normal speed is. There's a posted speed. And then there's the speed that 80. I think the term is 85%. Percent. Of. The vehicles travel at. And that's generally more than 25 miles an hour. It might be. That you still have sufficient sight lines. But I can't tell. So. To clarify. So that. Point with regard to the actual. Speed. On those. Three. Roads. You would a comment. On the. Speed. On the. Speed. Of. A. Road. And then. You would a comment. Be sufficient. You actually want. Some kind of. Physical. Yeah. Normally. They would. They would. Have a diagram. That shows the intersections. Of those. And arrows pointing. In each direction of travel. With a speed sitting right on it. Robert can probably send you a sample. From one of the other reports. Okay. That would be helpful. And. More of an explanation. Of why. On the eastbound side. He only goes down to 15. Miles per hour speed. And show where the stop sign is. Next thing was the special permit. Yeah, relation for 80 years. Yeah. So this is concerning now that we checked modified the requirements pending ages approval, which I've not received yet. This is just pending that we probably be good practice. So we have to create our own rules and regulations for this. So we have to run file for when someone applies. I do not believe currently today we have any kind of rules and regulations for any kind of special permit. Probably the only thing we probably would have is for me potentially like an aquifer protection district. But I think it'd be good practice that gives be a give someone a rules or regulations that would be according to a specific rules or kind of special program than just generic. So it kind of follows the same kind of patterns of other rules and regulations, explaining what it is, giving applicability what it is referencing, giving up setting the fee schedule, providing some definitions. The process of what happens who, how many copies and you need to submit what do you need to submit? Explaining what you know, what would be in equation submission? How do you withdraw? What application public notifications? And if you need to get the play on any time can modify or modify the regulations. I have drafted this in the past, the other rules and regulations that have cited that the plan board must post for a advertise meeting to modify the rules. I have drafted that the plan board at any meeting could modify or amend this. And that is just so that it's not as heavy to make a modification, knowing that this is specifically that that once you mend it or change this, the plan board, that unless I'm dramatically changes, or something is completely wrong and even modify, I would not suspect this will be changed much in the future. Unless I'm unless I'm crazy happens. And there's something that's completely wrong or but I don't think this is something that's going to be modified over and over again. Yeah, that's one thing. Start with that first. So in the past, in the last six months now, the town has gotten a gift fund of 60,000 hours from a project that Suckboard within the last few months have appointed that 20,000 hours. And, you know, we still might need assistance. And as Robert said, he reached out to a number of law firms and hasn't heard anything back. I put a list together of people that I've dealt with over the years, just friends kind of people. Not that they would be doing the work, but I thought I would reach out. And see if they knew of any youngish lawyers wanting to start doing things like this. And if you know of anybody, Robin, that would be great. I know. The wrong line of work. And then we probably we need some kind of we need some civil work from Suffolk law to work on this project. So, right. Some kind of a meeting. And we have that outline that we put together. That we spent a lot of time on as the core for to start drafting from that's one thing. And then I have been working on trying to get authorization. So we have the clean energy information sitting permitting. This is for solar panels. And there's a new whole new process that needs to be done conducted by the town. We have a local official. And yet when you have a sore ground matter, so our project someone comes in. Then you have. You can talk to who sets up view the application, sets up all of the information and sets of all the discussion with different view committees. I've been working out with the select board and trying to get that done so that the select board has indicated who the local official is at this time. They still have not done that. So I have started also working with and reached out to NBC, the local regional has the regional office. And they have offered support to help us write eventually rate the ground matter solar by law if we choose. It sounds great. So I have had that meeting with fellows from from the NBC. I had Olivia sit in so that it was not just me making a decision. And Ellen from from the Energy Climate Committee is also supportive to try to get this done. So at this point, it's. The point is. Is there anything else for updates? I went to the housing partnership meeting. You know, they've got things they're working on. Good Shepherd seems there's no update. The housing production plan they're working on with Robert and Anina and everybody. I have an update on that, too. Yeah. And then so they wanted to talk about how to encourage people to build ADUs. I'm not sure there is a way to do that. But, you know, I did suggest that maybe they should see if the Board of Health is interested in, you know, just suggesting to people when they're getting approval for a septic system to say, you know, just so you know, if you ever want to build an ADU, you could over-design your capacity so that you could build an ADU later on without having to go to such an expense. And so they were going to write to the Board of Health and just suggest that they, you know, if somebody comes in and they said, you know, by the way, you could consider adding capacity so that later on you have this option. And they liked that idea, so they were going to follow up on that. And then they would like to have a meeting with Mr. McCall and the planning board about suggesting, you know, that the town reduced lot sizes and allow alternatives to septic systems so that people can build more houses closer together. Like what would they use instead of septic systems? There are some other sort of, I don't want to say crunchy, but there are some other alternatives. That are approved by MassDEP? I don't know, but they want to talk about it. And I said they... They should, you know, they wanted to meet with us first. And then Mr. McCall and I said, why don't you just schedule one meeting where we're all there? We can do it quickly and move on. Yeah, I would suggest to them that they check with their alternates. Yeah, supposedly these things do get approved in other places, but they should run it by the Board of Health. Actually, they should invite the Board of Health to the meeting too, so. Yeah. But anyway, that's what I have to report. When you say in other places, in Massachusetts? Yep. Really? Yep. They've been pretty picky over the years. Yeah. No, supposedly there are some alternatives. So it got different. Yeah, because they mentioned you're... You're sort of past your deadline, so you have to wrap it up. They got past the deadline by a month, which is not a deal. The ZBA denied a project for a special permit, which they didn't give the applicant the chance to withdraw without precision, which they should have, but they didn't. Otherwise, anyways. There's a statute in the Master of Law that allows an applicant to reapply within two years if they can show and get approval from the planning board and the ZBA that the project that they're proposing is essentially different than the project that they got denied. So for this project, there is a single-family house on non-conforming lot. They are going to, in the next few months, reapply and submit to the planning board and the ZBA. And the planning board and the ZBA must make a determination that the project that they are submitting is different than the project that got denied. And we have to agree, I assume, that the project they're submitting is substantially different. Correct. You're not approving the project. A lot of people. You're not denying the project. You're just saying, approving, you're just agreeing that this project is different. I've seen what they propose. It is different. But I have also asked them to really spell out. Here are the differences. Here's the floor plans, why it's different. Here's the renderings of why it's different. Really give you all the information so that to you it's very clear or not clear that it's different. That is a statute that I've never seen before, but we've asked town council, and I reviewed it, too. It is in the statute, but the bar is very high, too. It will require a supermajority of the board to vote in favor, or not vote in favor, but vote in agreement that it is. So the differences, in order to be substantial, do they have to be differences that have to do with the reason it was denied? Like if it was denied because it was, this doesn't make sense, but it's the only way I can get this. If it was denied because it was red. And instead. The difference is that they added a window, but it's still red. Is that a substantial difference? I think what you're looking at is size, height, massing, things that would determine, like, yeah, this is a different house. They changed the R-TAC to who it is, so they completely got rid of the R-TAC that they used and got someone brand new to come in and modify the project to show that it's different. Okay. But. So I'm saying, so if it was denied because of the height. And what they did was they changed the massing, but not the height. To me, that's not a substantial difference, perhaps. Is there any guidance on that? On what substantial? There's no real guidance on it. There's case law, but there's no guidance on exactly. We might need some. Yeah, we might need the case law, too. Yeah. I mean, I have the case law. Yeah. Okay. Perhaps share it with us when you. Yeah. But I mean, it would be based on the height, the size. The issue they had was how much square footage it was. I originally gave the ZBA or wrote up a did a quick model of the neighborhood and showed that the house proposed house is much larger than anything in the neighborhood. And they ZBA used that they modified once and then eventually the ZBA just denied it. And the applicant would like to come back in within the two years to redesign the project. So they have they have their work cut out. They need to really convince the plan board and the ZBA that it's a complete different proposed house. And I think that's the dream right now is to really to put that together. So I will be on the agenda once we have an idea and they will have to provide some further information and narrative to explain exactly why. So. But that's coming down the line. I would expect that coming in within the next month or two. So just be ready to really it's a really weird request, but it gives the applicant the chance to come back within two years so they don't have to wait it out. Robert, the scenic road thing. Do you want to brief the board on that? I think it's been resolved, so I'm not really. Well, I want I want the board to understand. So I'll. Now, there was a request from someone about a. Cut doing a new curb cut into a scenic road on plane plane road. I think it was playing doesn't make any difference just to scenic road. Yeah, it's in a road I discussed it with the app. The app can provide a request. I discussed it with the DPW and according to him, I was not aware that it would not be allowed and that circus in the past, the previous town planner allowed it under some provision. Before we posted or did anything or collected any money, money or did anything, I just discussed it with the chair and it was determined that it would not be allowed. You can't have two driveways on any kind of scenic road. So how does happen in the past? The bylaw was modified in the nineties, so if anybody came in before that, then they were fine. But after the nineties, if this one someone if someone did a second curb cut. Then they did it with not their correct permission by the plan board, because the plan board deals on the same road is stonewalls or a star trees. And that's the need of this request so that it will not become a friend. The way the bylaw reads is that you may only have 1. Driveway cut on a scenic road. Per lot, they already have a driveway cut. The gentleman said he didn't feel like it was. It was safe and he wanted to have 2 ways out and and if you look at the bylaw, it says that the planning board can hold a hearing for for dealing with trees on a scenic road, or if we're dealing with stone walls on a scenic road, that's all. It says, so we don't even have the ability. To deal with it, I wasn't aware that circus did that. I have no idea which houses. He may have done it for and it did not go before the board. I'm sure because it's not provided for, and I don't remember ever seeing them. And I actually always watch that because I think it's important to have 1 curb cut on the scenic roads. So I, I told Robert that I just didn't think that we could even have a hearing because I didn't think that under the bylaw, we could address it, that the gentleman could go to the DPW. And. Change his curb cut, he could choose whichever 1 he wanted. And, you know, that would be fine and he'd have to close 1 and open a new 1. But I want everybody to understand those things because. It's disturbing to know. Or to think that a prior employee of the town. Would have violated the bylaw when it is absolutely clear what it says. Okay. Yeah. We have petitioned at the last time meeting to add code to the legislature and ask for more liquor licenses. The state has asked us to create a map of showing where we would like to see up to 10 liquor licenses be presented. We provided the state and provided them feedback of here's what we're gonna do. And most of it was based on the town center, Route 20, and the roadside business area, which has leaf farms, because they also are potentially thinking of something. This would only be for a full liquor license. It would not be for beer and or wine malt. We have those licenses, but it doesn't quite affect the planning board exactly, but this is also any kind of new site plans or business in the future, this would be affected, you know, having the correct resources in our back pocket in case, you know, sending a town center. Right now, there'd be no full liquor license for the town center, if the town center wanted to bring in. You mean no extra ones? No extra ones. Not that they would. I was gonna ask if you were discussing this because you thought that the planning board and the members needed more places to go drink. Well, I mean, we're looking at the town center and they are bringing in new businesses. Yeah, they're trying to, yeah. There's a new, they announced a new business today. If you can find it online, there'll be a new ice cream shop coming in to Wayland Town Center, so. Great. New City Creamery has announced today on the Instagram that they're moving from Sudbury to Wayland. And so, wow. Next spring, we should be having an ice cream shop. People are asking where's, and like, I don't know, where in the town center, somewhere in the town center. So, we're following it in ice cream shops, but I think they are looking at bringing some more new businesses, new restaurants in. With Terrain coming in, you know, starting today, people are gonna need places to have rehearsal dinners and stuff like that. Yeah. How was Terrain today? Mod. Was it really? I swung by because I had to go to the post office. Mod. Because over the weekend, it looked like it was mobbed, and, but I didn't think it was. It was a lot. That was just people working. Oh. And I think the town center is, is very supportive. They've been really posting about a lot and, and they just want to be good neighbors and be supportive. So we'll see what comes from that. Yeah. And for the town center hearing, we have everything that we need for the hearing. Yeah, they provided all the information. I double checked the person who signed off is the legal Senator.
