seeing that it is 6 32 and we have a quorum i'd like to begin the conservation commission meeting um first january what 7th 2026 um second paragraph this meeting may be recorded and if recorded will be made available to the public on wake cam as soon as possible after the meeting public will be excluded from the executive sessions by the way lynn that's a way better way to say that than he had before i'm glad they whoever wordsmith this this time uh in pursuant chapter 2 of the acts of 2025 this meeting will be conducted in person and or via remote access in accordance with the applicable law if this meeting has only remote access no in-person attendance by members of the public will be permitted if this meeting has remote access one may watch or may participate remotely with the meeting link that can be found at the following link but when required by law or allowed by the chair persons wishing to provide public comment or otherwise participate in the meeting may do so at the meeting location in person or remote access as applicable as applicable public comment should be limited to two minutes per person with that uh looks like all of us are remote so linda hansen cliff lewis lisa aubin barbara hall luke leger jenny brown and myself are all dialing in remote with that uh let's kick it off here um we are not doing the joint planning board piece but let me at least open this up so we can continue this is uh essentially 2a 37 45 47 waltham road wayland mass is also known as the carroll school d-1046 it's a continued request for determination filed pursuant to wayland's wetlands and water resource protection bylaw and the protection act in chapter 193 submitted by the carroll school for the construction of a new school building an associated parking area septic system and utilities at 37 39 and 45 waltham road and wayland mass proposed work is partially within 100 foot buffer zone of a boring vegetated to wetlands property is shown on assessor's map 5 drive in wayland mass the proposed work is within 100 feet of deadly pond and the property is shown on assessor's map uh 46b parcel 35 linda this applicant has also asked for a continuance until june 28th meeting after 6 30 in january january wow moved forward a little bit january 28th after 6 30. okay do i hear a motion please yeah i move that we continue the hearing under the state act and existing church and construction of three new buildings parking surfaces a courtyard of sports field the stormwater management systems the project is within within a 200-foot riverfront area a 100-foot buffer zone of a boarding vegetative wetland property is shown on the assessor's map 40 parcel 08 linda um i have uh the applicant has asked for a continuance we are having an in-person meeting next week to discuss the off-site mitigation um and any of the commission members is welcome to attend that's 11 o'clock at the town building but they would like to do that linda um thursday at 11. this coming thursday uh not tomorrow but the week from tomorrow oh we've been tomorrow okay i can't make that okay um and they have asked to continue till march 4th okay is it my understanding i thought i read and at least because we had in some of the the pre-read documents that they're now going to do everything in one phase is that that that's what they're reflecting in in their response to responses yeah yeah that's how the planning how they're going to get that all done in five years but that's another story yeah three years right well i think the planning board decision is five years so that's where this came from is that i think the phasing they wanted to eliminate and so they would get one decision from the planning board for the entire project but i think even for maybe stormwater or wetlands regulations some of the peer review comments were and maybe i'm getting confused because there were a lot related to zoning and planning boards excuse me um where some of the information wouldn't be available until the later phases so i'm guessing now that if everything's well we'll worry about that when the time comes but um okay dude so we want march 4th 4th after 6 30. vegetated wetlands and a 200 foot riverfront area linda the applicant has also requested a continuance i believe what um he's been asked to do is file a site plan review with a planning board um and boring but to tell you the well end bank and land under water linda i believe we have the homeowner here um i i was i was in conversation with his representative which is uh kevin o'leary who said he was not available to 7 30. so i didn't know if you wanted jeremy do you want to introduce the project or you want to just um ask us to continue to the next meeting i guess i was going to ask your guys advice i mean do we need kevin for technical questions or um should i just introduce the project and hear what you guys need i'm new to these things sorry well if i could maybe if i may sean please to do a water line next year or um or in the coming or this year probably so the whole place is going to be ripped up again all right and paved over so that's efficient
is they know exactly where the gas line is now because there's a big strip of pavement there so

this one i remember when they turned 100 we thought that was a big deal wow 2012 it says 2012. so yeah i mean we're we're going after you know we need to return a lot of these performance guarantees so again i think i mentioned this before the easiest ones are the ones that already have a coc and you know they were issued that was closure and for some reason they didn't get their performance bond back so now it's just a matter of trying to get through some of them that are like you know easy picking sort of so cool all right uh for i'll go with that and kind of get in a motion please for the alvin yes cliff lewis yes sean fairza yes thank you folks five b pine brook blockage issue linda i believe all of you received an email that was i forwarded from an abutter who was very concerned about how um there was changes to the outflow of the farm pond over a main stone there was also um boulders of big rocks put into the stream in order to block the flow and i think that's done had a serious um effect on pine brook itself and like i said i didn't realize that there was so much flow coming from that farm pond but i mean i think combined with the drought i think what we've had is some really low water in pine brook and you see it from um i mean sean's been remarking about that for a while years i've been talking about that yeah yeah um walking over walking over the boardwalk there in pine brook conservation area it's just it's unbelievably dry over there so um what i've done is i've asked our town um surveyor to go over there at some point some of the the rocks are actually looks like they're within the right-of-way of rice road and we would have access to that and we could we can remove those if they're within town property and if they're not we can identify what property they are on and then there's also weir that i guess blocks the flow of um the farm pond and i guess there's i'd like to get a good explanation of why that was done i mean why why they chose to um retain more water there and i think sean offered to um make make a uh contact dev hamlin and have a discussion about that right yep i'll call that let's listen to this clip have you i mean riparian rights have been contested for thousands and thousands of years i don't think we have any jurisdiction to regulate flows of streams well in this case we might it's dried up the wetland but you know that's sort of god's work and you know we can't demand that people release x number of cubic feet of water every month or every or anything yeah my dad was talking to me just kind of just kind of understand when i'm talking to dev and say hey did you did you know the effect of that yeah asking a question is perfectly fine yeah yeah yeah yeah yeah he's he's pretty pro conservation so i thought yeah he's usually quite good yeah yeah um all right uh it is it is a cold water stream though you know it is it is an officially designated cold water stream pine brook is and the other thing we do is we do have a cr on this property so if the the baseline conditions have changed um from you know when the cr was first um signed and granted to conservation and to svt i mean i think we have a case we may have at least you know some issue there that you know it's the conditions have changed they need to go back to baseline right i know what's your thoughts luke yeah certainly if there's a cr on the property what you just said linda would be exactly right um and i think you know i understand what you're saying cliff i think every situation is different right so it's also conceivable if they went in and altered wetlands that led to this blockage uh without a permit then that you know that is something that's within our jurisdiction so i think what we're proposing here is exactly the right move yeah have a conversation and see what we can learn yeah deal with it from there yeah okay all right so i'll let you know how that what i learned from that um no topics on my end um don't end up when we get off real quick i do have to hop cpc is happening right now i have to hop into that after this i do a question before i get on that so i'll call you after this before i go to the cpc meeting um uh public comments i didn't see any hands correct okay um last thing babs how are we looking for the minutes uh of december 17th i was all right with them as if linda was gonna give him a
