Today is September 16th, 2026. It is 6.01 p.m. and this is a meeting of the Community Preservation Committee.
I'm your host, Susan Weinstein. And we don't have an onerous agenda tonight, but this is just to get us in motion for the application process for projects for the Community Preservation Act for the 2027 Annual Town Meeting. I guess I should say, joined by Leslie Stewart, Doug Stotz, Kay Gardner Wescott, and Maureen Cavanaugh, and Robbie. And Robbie.
All right. I see no public comment. I have a question about numbers. Who is Chris Reynolds replacing? He's not. He's the liaison from the select board. Oh, right. We had Anne. He doesn't count for a quorum. Okay, that's right. I just, yeah, I knew that. Okay. Thank you. All right. So we have two sets of minutes to review. The first being January 7th of this year. So that's good.

So the commission did a second one, and they kind of have 120 people there, which is remarkable. Yeah. For this town.

The next paragraph prior to the last word, currently unfulfilled. Sorry, adding the word currently. Where? The next paragraph. Yes. Just before the last word. Okay. Currently. The seats is currently unfulfilled. I mean, unfilled. Filled.

Pretty heady comments, huh? Yeah. When was that? Top of the second page, taking out the words annual town meeting and putting in ATM. And then when you go down the list to 25,000 for archeological monitoring at projects, add the words CPA hyphen funded prior to the word projects.
Again, on the next section where it says the following applications were not submitted for consideration, taking out annual town meeting and putting in ATM. In the one, the third bullet on the second line,
after the word cost and the end paren, adding in because it. So it says, because it is disproportionately.
And then on the first line of the last paragraph, taking out community preservation act and adding in CPA instead. And all that is to prove that Maureen read it. That's right.
Can I ask a question? Please. Why are the initials more important than spelling it out for people who don't understand what the initials mean? Well, the first time we mentioned those things. I know. But are people smart enough to figure out that that refers back to the. We're in Wayland. Of course, they're smart enough. If you're not going to abbreviate it, then don't put it in friends at all. But if you're going to say annual town meeting ATM, then you use ATM after that. Yes. All right. So ATM. I didn't read it close. And CPC are all abbreviated once. And then they're. Yes, I get it now. Is there a motion to renew our membership and pay the annual membership dues of $4,350 to the Community Preservation Coalition? We move that we renew and pay the $4,350 out of admin funds. Thank you. I don't particularly have updates or status whatevers, but I just thought I'd give people a chance to share. Here comes Kay. I'm very happy. Very happy, Doug, to hear this. Things are being closed out. Closed to. Closed to. Closed to the bridge. The sign for the Castlegate and for Dudley Woods are completed. They're over at the DPW. They have been shown, the man who is installing them, it has been shown where they're to be put. And depending on whether or not we have to pay for the insulation, there may be a return of money. Okay. Great. Congratulations. Yes. I'm excited. Great work. Is there anything different about the cemeteries now? I mean, the projects? The guy left, right? Yes. They asked that we break the contract, which we did do. And Brad Carver is meeting with Jalen over an RFP. And I don't know, at the last meeting, he reported that he was meeting before our next meeting, but I don't know if it's already occurred or not. Okay. So you guys aren't giving up on it? No, we're not. Okay, good. So you won't use the original RFP because it needs to reflect the work that's already been completed? Well, because they did about a third of the work. So this is going to be a third less of the money to go out. So they're doing another RFP. Okay. Great. Anything wrecky? You know, I didn't get a good update on where our projects are. I know we're still working on a few. So no update, really. But just I heard that there will be a couple of new applications coming through. One for an opioid issue and then a playground issue. So yeah, I think we have to look at the eligibility criteria. Yeah. Yeah. Yeah. So I asked for more information. Awesome. Thank you. Housing-wise, the Affordable Housing Trust is still in limbo with the land court for deregistering the property at 12 Hammond. And it's been going on for a year. It's ridiculous. So we're still in good communication with Habitat to do the construction. We've done all the condo documents and all of that stuff. So we're just waiting for the property. What does it mean to deregister it? There's registered land and then there's recorded land. And so there are these restrictions on it when it's registered. You have to take it out of registration so that you can then treat it as a land to be reported. Oh, wow. Okay. You don't want registered land. No, you don't want registered land. Apparently. That's what registered land is. I don't remember why people do registered instead of recorded, but I went to law school a long time ago. Before we registered land. The, this is not new news, but the trust made a commitment of $250,000 to the project at St. Anne's and they haven't been in touch with us for the money yet. I don't think. I can tell you they were not funded by Executive Office of Housing and Liberal Communities in this last round. Okay. So they just. I'm just impressed that you know the name of that. HLC. Well, you see DHCD. I know. I just call it HLC. But Healy and Driscoll announced the awards as sort of a pre-election thing. One of my projects up in Salem and it was not on the list. So you're probably going to hear from them until they post it back in line. Okay. So, well, we'll see. But I, I mean, I've heard that they've, they're making progress. Yeah. I mean, pending office for urban affairs is like, I'm working on three or four projects with them right now and they're great. I mean, they're, they're really quality projects and they're well run. So it'll happen. Yeah. Yeah.
CPC money. CPC money. Okay. I think that's all I have on that.
Doug and I will put our heads together and make sure that we're on top of the finances. I sent you the most. In Sean's absence, I'm going to proffer an update on the 25 York road or walk, which if you'll recall for longest time, the issue was that 25 York is town owned. And adjacent to it is the 10 acres at 27 York road, where the town has a conservation restriction on, um, it's drier and would be better to run the path through that conservation restriction. Uh, for the longest time, Linda Hanson, wasn't able to get any reading whatsoever from the, any response from the landowners. Uh, they finally spoke and they are represented by a lawyer who is 89 year old Henry Dane of Concord. I can't say I know him. Yeah. Everyone knows Henry, right? Yeah. Yeah. My mom used to work for him. Um, so they met around Memorial day. We got a, uh, town got a, uh, letter from Henry on September 3rd, uh, wanting. So in, in the, it's the damnedest map of a conservation restriction you ever saw, because in the area well away from the house, there's about 1.25 acres of unrestricted land that are islands. Ideally, that becomes false under conservation restriction. Uh, the conservation restriction also goes within about 25 feet of the, uh, owner's house. There's clear scope for a simple swap of 1.5 to 2-ish acres. Um, also the conservation, it's a 1989 restriction, which is not written with the same rigor as they are today. And in fact, that restriction does not allow the town full public access or the ability to do foot trails. So the conservation commission owes a response to that letter, but there seems to be such powerful incentives for both parties that, um, you know, it won't be a, a real cluster, so to speak, if something doesn't happen. Um, yeah, well, that's encouraging that there's this opportunity. Yes. Motivation on both sides and clear ability to, uh, you know, for a swap that works for everybody.
And because it's a conservation restriction, it doesn't just go to 10 meeting. Yes. Because it's not like a whole property. Okay.

At some point, we'll need to update the list of projects. Oh, I did submit our reports to the Department of Revenue. Because you have to put in each new project and then I should, I will go back and print out a list and just make sure that the, we close out ones that are closed out. I just have to get from each project. You're supposed to put in like the actual final cost.
And I need to see if there's other information I need to get. Yeah. Well, is it just final costs to the CPA funds that we use? Um, I don't remember whether it's both or just, uh, I mean, if it's, if it's just the community reservation funds then, but they do ask for funding sources. So I think they probably want to know. Because there were 13 signs contracted to be done by money that we received from the state for, and it was decided to use for the rail trail. Um, but see, uh, whatever their initials are.
What do they do? What? What do they do? Are they maintaining the... CR? MCRT or DCR? No, neither one of those. Anyway. CR? Something. I'm thinking CR or something. Yeah. Anyway, um, they would not allow 13 signs on. Um, so we were, we were whittled down to 10 signs and, um, Bonnie Gossel is a member of the community and went before the select board and asked, well, we've already contracted, we have to pay the money. So why don't we do the Dudley Woods and the, um, Castlegate signs? And that's how it got done, because there wasn't enough money there to do them. Okay. But that's why I'm saying I don't know whether the contract for installation was for 13 signs or whether it was just for the 10 signs and they're doing 13. All I can say is we do the best we can. Yes. Okay.
All right. Um, so I have the massive, uh, spreadsheet from Brian Cavaney and as usual, I don't understand it, but it seems like the numbers that we had predicted at our annual report to the town at the town meeting, it seems like those are close. I saw, I saw some similar numbers. So I'm going with that. I will share this with you sometime. Are you a numbers guy? Oh, this one's going to look. Yes, you left. Yes. I just know that every time I go to look at them, I have to lift up a page to see what the application is. So. That's a good ad. Why is that? All right. But I didn't want to make people do it. So, I just made it that I would do it. All right. Yes, it's only five of the live. I thought, I mean, I took some of, I took a little bit of the verbiage out from the overview.

We could work a little sooner. I think our willingness to do it two nights that week is probably enough. We didn't go to two nights this year. We didn't go in one night. We actually have only one meeting scheduled for December. And that's right at the beginning. If you're doing it to save me from the work, then that's very kind. No, I'm fine with it. Because after that one is when I have to be drafting all of the foreign articles. It just seemed to me that there wasn't a reason for doing it earlier and that we had talked about doing it earlier. I think the thing that we talked about adding in, which I did add, was a meeting so that people had questions that they could come. Right. And we did that. I did that early. Maybe that was it. Yeah, that's the October meeting. And Chris says, has there been a settled upon date meeting yet? Yes, but I forget what it is. April or May?
I forget what it is. Okay. But I know there was euphoria that they settled. Euphoria. But I didn't put in anything of that meeting because I didn't know what it is. The Attorney General's Office just approved a broader number of which to schedule it. So that led to early euphoria. Yeah, yes. We're operating under the assumption that the bylaw still holds that the warrant articles will be due on January 15th.
That's our schedule. All right. If we're good with the application and we're good with the schedule, then we're good.

And the first one is to develop a plan amongst the group to guide our, and I wasn't sure when the last time we had done that, or maybe that's the next meeting. But I think that would have helped me last year to know what our priorities were. So when certain things didn't go forward, I didn't take it so personally. I think that we did one in 2021. That's my recollection was that. We can certainly look at it and see if there's priorities we want to change. Yeah. But the other thing is, I mean, I know we'll be doing the housing production plan for 2027. I don't know what the status is of any open space and recreation plan, but the idea was that we would, when those things are done, then we incorporate... Well, that's actually a good point, because I think the last open space and recreation plan was 2017. I believe there are several state programs where a valid open space and recreation plan is required to be eligible. And this came up... We funded... Yeah, and we funded a refresh. They were trying to do as much as they could in-house. Yeah, and so, for instance, like 24 Holiday, that is listed on 24, 25 Holiday Road. That's listed on the OSRP as being a fine place to expand the cemetery, for instance. And I'm not sure that represents the consensus of the town at this juncture. All right. Well, before we get into anything substantive that's not on our agenda, I think that that... We can put it on the agenda for the next meeting, just to touch base on it, and maybe people can take a look at it. Great. I'd love that. All right. They have been shown, the man who is installing them, it has been shown where they're to be put. And depending on whether or not we have to pay for the insulation, there may be a return of money. They asked that we break the contract, which we did do. And Brad Carver is meeting with Jalen over an RFP. And I don't know, at the last meeting, he reported that he was meeting before our next meeting, but I don't know if it's already occurred or not. Okay. So you guys aren't giving up on it? No, we're not. Okay, good. So you won't use the original RFP because it needs to reflect the work that's already been completed? Well, because they did about a third of the work. So this is going to be a third less of the money to go out. So they're doing another RFP. Okay. Great. Anything wrecky? You know, I didn't get a good update on where our projects are. I know we're still working on a few. So no update, really. But just I heard that there will be a couple of new applications coming through. One for an opioid issue and then a playground issue. So yeah, I think we have to look at the eligibility criteria. Yeah. Yeah. Yeah. So I asked for more information. Awesome. Thank you. Housing-wise, the Affordable Housing Trust is still in limbo with the land court for deregistering the property at 12 Hammond. And it's been going on for a year. It's ridiculous. So we're still in good communication with Habitat to do the construction. We've done all the condo documents and all of that stuff. So we're just waiting for the property. What does it mean to deregister it? There's registered land and then there's recorded land. And so there are these restrictions on it when it's registered. You have to take it out of registration so that you can then treat it as a land to be reported. Oh, wow. Okay. You don't want registered land. No, you don't want registered land. Apparently. That's what registered land is. I don't remember why people do registered instead of recorded, but I went to law school a long time ago. Before we registered land. The, this is not new news, but the trust made a commitment of $250,000 to the project at St. Anne's and they haven't been in touch with us for the money yet. I don't think. I can tell you they were not funded by Executive Office of Housing and Liberal Communities in this last round. Okay. So they just. I'm just impressed that you know the name of that. HLC. Well, you see DHCD. I know. I just call it HLC. But Healy and Driscoll announced the awards as sort of a pre-election thing. One of my projects up in Salem and it was not on the list. So you're probably going to hear from them until they post it back in line. Okay. So, well, we'll see. But I, I mean, I've heard that they've, they're making progress. Yeah. I mean, pending office for urban affairs is like, I'm working on three or four projects with them right now and they're great. I mean, they're, they're really quality projects and they're well run. Doug and I will put our heads together and make sure that we're on top of the finances. I sent you the most. In Sean's absence, I'm going to proffer an update on the 25 York road or walk, which if you'll recall for longest time, the issue was that 25 York is town owned. And adjacent to it is the 10 acres at 27 York road, where the town has a conservation restriction on, um, it's drier and would be better to run the path through that conservation restriction. Uh, for the longest time, Linda Hanson, wasn't able to get any reading whatsoever from the, any response from the landowners. Uh, they finally spoke and they are represented by a lawyer who is 89 year old Henry Dane of Concord. I can't say I know him. Yeah. Everyone knows Henry, right? Yeah. Yeah. My mom used to work for him. Um, so they met around Memorial day. We got a, uh, town got a, uh, letter from Henry on September 3rd, uh, wanting. So in, in the, it's the damnedest map of a conservation restriction you ever saw, because in the area well away from the house, there's about 1.25 acres of unrestricted land that are islands. Ideally, that becomes false under conservation restriction. Uh, the conservation restriction also goes within about 25 feet of the, uh, owner's house. There's clear scope for a simple swap of 1.5 to 2-ish acres. Um, also the conservation, it's a 1989 restriction, which is not written with the same rigor as they are today. And in fact, that restriction does not allow the town full public access or the ability to do foot trails. So the conservation commission owes a response to that letter, but there seems to be such powerful incentives for both parties that, um, you know, it won't be a, a real cluster, so to speak, if something doesn't happen. Um, yeah, well, that's encouraging that there's this opportunity. Yes. Motivation on both sides and clear ability to, uh, you know, for a swap that works for everybody.
And because it's a conservation restriction, it doesn't just go to 10 meeting. Yes. Because it's not like a whole property. Okay.

At some point, we'll need to update the list of projects. Oh, I did submit our reports to the Department of Revenue. Because you have to put in each new project and then I should, I will go back and print out a list and just make sure that the, we close out ones that are closed out. I just have to get from each project. You're supposed to put in like the actual final cost.
And I need to see if there's other information I need to get. Yeah. Well, is it just final costs to the CPA funds that we use? Um, I don't remember whether it's both or just, uh, I mean, if it's, if it's just the community reservation funds then, but they do ask for funding sources. So I think they probably want to know. Because there were 13 signs contracted to be done by money that we received from the state for, and it was decided to use for the rail trail. Um, but see, uh, whatever their initials are.
What do they do? What? What do they do? Are they maintaining the... CR? MCRT or DCR? No, neither one of those. Anyway. CR? Something. I'm thinking CR or something. Yeah. Anyway, um, they would not allow 13 signs on. Um, so we were, we were whittled down to 10 signs and, um, Bonnie Gossel is a member of the community and went before the select board and asked, well, we've already contracted, we have to pay the money. So why don't we do the Dudley Woods and the, um, Castlegate signs? And that's how it got done, because there wasn't enough money there to do them. Okay. But that's why I'm saying I don't know whether the contract for installation was for 13 signs or whether it was just for the 10 signs and they're doing 13. All I can say is we do the best we can. Yes. Okay.

Um, so I have the massive, uh, spreadsheet from Brian Cavaney and as usual, I don't understand it, but it seems like the numbers that we had predicted at our annual report to the town at the town meeting, it seems like those are close. I forget what it is. Okay. But I know there was euphoria that they settled. Euphoria. But I didn't put in anything of that meeting because I didn't know what it is. The Attorney General's Office just approved a broader number of which to schedule it. So that led to early euphoria. Yeah, yes. We're operating under the assumption that the bylaw still holds that the warrant articles will be due on January 15th.

I have a question. Okay. I was doing my research online because I wasn't sure if I was going to be appointed again. And so I wanted to make sure if I wasn't appointed that somebody would have the information they needed to get started. And I was looking at the three purposes of the commission. And the first one is to develop a plan amongst the group to guide our, and I wasn't sure when the last time we had done that, or maybe that's the next meeting. But I think that would have helped me last year to know what our priorities were. So when certain things didn't go forward, I didn't take it so personally. I think that we did one in 2021. That's my recollection was that. We can certainly look at it and see if there's priorities we want to change. Yeah. But the other thing is, I mean, I know we'll be doing the housing production plan for 2027. I don't know what the status is of any open space and recreation plan, but the idea was that we would, when those things are done, then we incorporate... Well, that's actually a good point, because I think the last open space and recreation plan was 2017. I believe there are several state programs where a valid open space and recreation plan is required to be eligible. And this came up... We funded... Yeah, and we funded a refresh. They were trying to do as much as they could in-house. Yeah, and so, for instance, like 24 Holiday, that is listed on 24, 25 Holiday Road. That's listed on the OSRP as being a fine place to expand the cemetery, for instance. And I'm not sure that represents the consensus of the town at this juncture. All right. Well, before we get into anything substantive that's not on our agenda, I think that that... We can put it on the agenda for the next meeting, just to touch base on it, and maybe people can take a look at it. Great. I'd love that. All right.
