The Zoning Board of Appeals voted 5-0 on Sept. 17 that 373 Commonwealth Road, LLC’s request to convert a 52-unit Chapter 40B rental development to condominium ownership, with 39 market-rate and 13 affordable units, is substantial rather than insubstantial under 760 CMR 56.05(11).
Chair Thomas W. White, who read a town counsel memo before the eight-minute remote meeting, said it was “pretty clear this would be a substantial change.” Members said all 52 units currently count toward Wayland’s subsidized housing stock but “only a quarter will count” after conversion, a loss of 39 units from the state tally. Board staff said MassHousing, which funded the 40B, would also have to agree. A full hearing is set for Oct. 13.
